Welcome to Forecastly. By accessing or using our mobile application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Forecastly provides a platform for financial forecasting and analysis. Our tools use user-provided data and algorithmic models to generate projections, reports, and insights ("Forecasts"). Forecastly is an automated tool and does not provide personalized financial, legal, or tax advice.

THE SERVICE AND ALL FORECASTS ARE PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. THEY ARE NOT INTENDED AS FINANCIAL, INVESTMENT, TAX, OR LEGAL ADVICE.

Not a Substitute for Professional Advice

You should not rely on the Service or its Forecasts as a substitute for professional advice from a qualified financial planner, accountant, or lawyer. The forecasts are based on automated models and assumptions that may be incorrect or not apply to your specific situation.

No Guarantee of Accuracy

We do not guarantee the accuracy, completeness, or usefulness of any Forecasts. Financial markets and personal circumstances are inherently unpredictable. Past performance, whether real or forecasted, is not indicative of future results.

4. User Accounts and Data

Account Creation

You may need to create an account to access certain features. You agree to provide accurate and complete information and to keep your login credentials secure.

Your Data

You retain all rights to the financial data, transactions, and information you input into the Service ("User Data"). By using the Service, you grant Forecastly a limited license to use, process, and store your User Data solely for the purpose of providing and improving the Service.

Data Accuracy

You are solely responsible for the accuracy and completeness of the User Data you provide. Garbage in, garbage out. Inaccurate data will lead to inaccurate forecasts.

Privacy

Your privacy is important to us. Our collection and use of your data is governed by our Privacy Policy, which is incorporated into these Terms.

5. User Responsibilities

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Upload any data that is infringing, unlawful, or contains viruses or malicious code
• Attempt to gain unauthorized access to the Service or its related systems
• Use the Service to provide forecasting services to third parties as a service bureau
• Copy, reverse engineer, or distribute any part of the Service without our express permission

6. Intellectual Property

The Forecastly app, its original content, features, functionality, and all Forecasts generated by our proprietary models are and will remain the exclusive property of Forecastly and its licensors. Your User Data remains your property.

7. Subscription and Fees

Free and Paid Tiers

The Service may be offered in both free and paid subscription tiers.

Fees

Paid subscription fees ("Fees") are as stated within the app. You authorize us to charge your chosen payment method for these Fees.

Auto-Renewal

Subscriptions automatically renew until you cancel. You can cancel your subscription at any time through your app store account settings.

8. Termination

We may suspend or terminate your account and access to the Service at our sole discretion if you violate these Terms. You may terminate your account at any time by deleting it within the app.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FORECASTLY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR FINANCIAL LOSS, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY FORECAST.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of changes by updating the "Last Updated" date. Your continued use of the Service after any change constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
